Terms and Conditions

This document applies to jackyzhang.app products, including AnyMail.

These Terms and Conditions (“Terms”) govern your access to and use of all software provided by Jacky Zhang via jackyzhang.app, including but not limited to desktop applications, web applications, plugins, and related services (collectively, the “Service”) provided by Noah Immigration and Education (Canada) Company (“jackyzhang.app”, “Provider”, “we”, “us”, or “our”). By subscribing to and using jackyzhang.app, you (“Customer”, “you”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

0. Scope of Service

jackyzhang.app provides technical software tools, including but not limited to form automation and data organization tools.

It does not provide immigration advice, legal advice, or case assessment of any kind.

jackyzhang.app does not review, verify, or confirm the accuracy, completeness, or authenticity of any user-provided information.

The Service is intended solely to assist users in organizing and generating information for their own reference or professional review.

Users are fully responsible for ensuring that all information entered or generated through jackyzhang.app is truthful, accurate, and suitable for its intended use (including immigration or legal submissions).

1. Subscription, Wallet, and Payment

1.1. Products are billed independently. Some products use a shared platform wallet (prepaid CAD stored value). Some wallet products are currently free and do not deduct from the wallet yet. FormBro is billed on its own subscription, separate from the wallet. EasyBooks is free for registered users.

1.2. Wallet balance and subscription status are available in the account center. Wallet top-ups are CAD and are not a product-specific credit pack.

1.3. Applicable taxes (GST, PST, HST) are determined under Canadian law. Wallet top-ups collect no tax; tax is recognized when a paid wallet product deducts for a service.

1.4. Failure to pay a due subscription may result in suspension or termination of that product’s access.

1.5. Paid subscription fees and wallet top-ups are final and strictly non-refundable, except where required by law. Wallet balances do not expire and remain valid as long as the Service continues to be provided.

2. License and Permitted Use

2.1. Upon payment, you are granted a limited, non-exclusive, non-transferable, revocable license to use jackyzhang.app in accordance with these Terms.

2.2. You shall not:

Reverse-engineer, decompile, or modify the Service;

Permit unauthorized third-party access;

Use jackyzhang.app to collect or process sensitive personal data without legal compliance;

Rely on jackyzhang.app as a substitute for professional immigration or legal advice.

You acknowledge that jackyzhang.app is a software tool only, and that you are solely responsible for reviewing and confirming the accuracy and legality of all outputs generated.

3. User Data and Privacy

3.1. All data entered or uploaded by you remains your property.

3.2. You grant jackyzhang.app permission to store and process your data solely for providing the Service.

3.3. We handle your data in compliance with PIPEDA and other applicable privacy laws.

3.4. You are responsible for obtaining necessary consents and ensuring compliance with all applicable privacy and data protection requirements.

4. Service Availability and Support

4.1. We aim to maintain 99.9% uptime, excluding scheduled maintenance or force majeure events (e.g., natural disasters, cyberattacks, outages).

4.2. Technical support is not included in subscriptions; users may consult the User Guide and tutorials on our website. Paid support options are available separately.

5. Termination and Suspension

5.1. Either party may terminate this agreement for material breach with written notice.

5.2. You may cancel anytime via your account settings; no contact with support is required.

5.3. We may suspend or terminate access if you violate these Terms or engage in unlawful or fraudulent activity.

5.4. Upon termination, access ceases immediately, and outstanding fees remain payable.

6. Limitation of Liability

6.1. Warranty Disclaimer

jackyzhang.app is provided “as-is” and “as-available”.

While we strive for accuracy, we do not warrant that:

The Service will be error-free, uninterrupted, or fully compliant with IRCC or other regulatory standards;

Any data or documents generated are complete, accurate, or suitable for official use.

jackyzhang.app is not responsible for verifying, validating, or reviewing the truthfulness or correctness of user-provided data.

6.2. User Responsibility

You are solely responsible for:

Reviewing and confirming all data and forms before submitting to IRCC or any government body;

Ensuring that information entered in jackyzhang.app is accurate, current, and lawful.

jackyzhang.app does not provide any assessment, advice, or verification related to immigration applications or supporting documents.

6.3. Limitation of Damages

To the fullest extent permitted by law, jackyzhang.app and its affiliates shall not be liable for:

Indirect, incidental, or consequential damages;

Loss of profits, opportunities, or reputation;

Any damages resulting from immigration refusals, misrepresentation findings, or regulatory outcomes.

6.4. Cap on Liability

In any case, our total liability shall not exceed the total subscription fees paid in the twelve (12) months preceding the claim, except in cases of gross negligence or willful misconduct by jackyzhang.app.

7. Confidentiality

Both parties agree to protect proprietary or sensitive information.

jackyzhang.app implements encryption and secure cloud practices to safeguard data.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and the Province of British Columbia.

Disputes shall first be resolved through good-faith negotiation.

Unresolved matters shall be subject to binding arbitration in Vancouver, British Columbia.

9. Amendments

We may amend these Terms by posting updates on our website.

Continued use constitutes acceptance of any revised Terms.
